Terms & Conditions

 

The following terms and conditions apply to all parent / guardians of children attending swimming lessons facilitated by Westbury Swim School.  Please ensure you read and understand the following and please ensure you keep a copy for your personal records.

Westbury Swim School is registered with the Company Registration Office in Ireland under Number: 478876.  The business name is Marie-Anne Cotter trading as Westbury Swim School.  The business holds a current Tax Clearance Certificate and is insured with a reputable insurer.

 

YOUR TERMS AND CONDITIONS

 Once you have booked a swimming lesson(s) for your child with Westbury Swim School you understand and accept all of the Terms below and you will adhere to any local rules. Acceptance of your application for swimming lessons is at the absolute discretion of Westbury Swim School.

By agreeing to these Terms. You acknowledge and agree that in entering this agreement you are not relying on any promise, assurance, statement, representation, warranty or understanding except as expressly provided in these Terms.

Swimming lessons can only be provided to the child named at the time of booking and confirmed by Westbury Swim School.

Lessons cannot be transferred to an alternative venue.  Lessons cannot be made up if a child is absent from a lesson.

Please ensure that your child and / or any accompanying children will follow the general pool rules that apply to the swimming pool and changing area where the swimming lessons are provided.

Accompanying children must be supervised at all times.

 

REGISTRATION AND CONTACTING US

Prior to booking a swimming lesson(s) you are required to register your details on our website: www.westburyswimschool.ie.  You will be required to provide your name, email address, telephone number which we will use to contact you and / or make a swimming lesson booking.  Your details will be held securely in our online customer account system.  This will be done in accordance with our Privacy Policy.

You agree that all information stored in your online account can be accessed by Westbury Swim School to ensure that you receive the most accurate information and communications about swimming lessons.

You will need to create an online account with the email address which we can contact you at.  This will be used to notify you of term dates, payment and other related information.

 

PAYMENT

 The lessons fee(s) will be confirmed with you at the time of booking online. You will be sent a payment request from Westbury Swim School. The term must be paid for in its entirety even if your child misses a lesson for any reason.

Payment must be made in full before the start of each term.

Should payment not be received in time for the new term, Westbury Swim School reserves the right to cancel your child’s place in lessons.  Your child’s place will then be offered to persons on our waiting list.

In the case where an online payment is not possible, we do accept cheques made payable to ‘Westbury Swim School’.  Details of the postal address for receipt of cheques will be issued.

In the interests of public health, we regret that payment cannot be accepted at the swimming venues.

 

MEDICAL CONDITIONS AND ILLNESS

Please inform us if you child has a medical condition (diabetes, epilepsy, asthma, anaphylaxis etc.  In certain instances, we will require a letter from your child’s G.P stating that they are medically fit to swim.

We regret that we do not provide refunds or credits for absence(s) from booked lessons due to illness, regardless of the number of lessons missed.  However, if your child suffers a serious illness, which affects him or her for more than 4 (four) weeks (such as broken bones or any condition that requires hospitalisation and / or medical attention) then we may, at our discretion, offer you credit for all lessons missed if you inform us no less than 48 hours before the first lesson to be missed.

If we offer you a credit under these circumstances but you do not wish to continue with swimming lessons with Westbury Swim School, we may, at our discretion, offer you a refund instead for the number of weeks remaining.

It is your responsibility to ensure that you or your child is medically fit to swim.  We will not be liable for any accidents or injuries arising from swimming lessons with us that relate to your child’s individual medical condition(s).

 

REQUESTS TO CHANGE THE SWIM LESSON DAY, TIME, VENUE OR TEACHER

Parents / Guardians do not have the right to change the day, time, venue or teacher for your child’s swimming lessons for any reason once the term has started.   If such a request is made, we may, at our discretion choose to allow you to do so if consider that the request is a reasonable request.

If your child refuses to get into the water or you decide you no longer want your child to attend the swimming lesson term, we regret we cannot give refunds.  Westbury Swim School can discuss the possibility of a credit for a future another term.

If at any time during a term you are dissatisfied with a member of Westbury Swim School teaching staff you are required to inform us immediately, either by phone or email, and afford us the opportunity to resolve the issue.  We will work constructively with you to find the best solution for all parties.

To ensure consistency in swimming lessons we will use our best efforts to ensure that your child will have the same teacher for each lesson within the term.  This cannot be guaranteed at times due to illness, holidays or unforeseen circumstances.  We will arrange for another Westbury Swim School teacher to cover these lessons.

 

CANCELLATION BY YOU

If you cancel a single lesson or the 6 (six) week term of lessons after you have paid for it, we are not obliged to provide you with any credit or refund.

If you request to cancel the scheduled term after the start date, you will still be liable to pay for all allotted sessions up to that point, regardless of attendance.

 

CANCELLATION BY WESTBURY SWIM SCHOOL

If we determine that there is insufficient support for a class, we have the right to cancel, suspend or postpone the course before the date of the first lesson.  We will give you as much notice as possible of any such cancellation and we will provide you with a full refund of your term fee if no suitable alternative is found.

We will make every effort not to cancel lessons once a term has started.  On rare occasions pool closure or other unforeseen circumstances may force us to do so.  We will give you as much notice as possible of any such cancellation.  In this event we will offer you a substitute lesson on a date designated by us.  If you notify us that you are unable to attend the substitute lesson in advance of the date scheduled for the substitute lesson, then you will receive a credit for the cancelled lesson.  This credit may be offset against your fees for a subsequent term.   If you do not accept the substitute lesson or do not wish to re-book for a subsequent course, we are not obliged to provide a refund.

 

RE-BOOKING 6 (SIX) WEEK TERM

Before the end of a course, we will send you an email offering you the chance to re-book for the next course within a specified time period.

If you wish to re-book you must notify Westbury Swim School by email.  You will be sent a payment request.

By re-booking, you agree to accept these terms and conditions and they will be incorporated into a binding agreement between us.

Re-booking requests that are not submitted before the ‘re-booking deadline’ will be treated as notice of cancellation for the following term and may result in the loss of your child’s place in the future course.

 

PARENT / GUARDIAN RESPONSIBILITIES

You are responsible for the care and safety of any children you bring with you into any part of the swimming pool venue including the changing area.

Babies / Toddlers must wear a swim nappy for the duration of the swimming class.  If your child is not toilet-trained they must wear protective swim underwear.

Parents / Guardians must remain on the premises for the duration of each swimming lesson.

For Baby Years classes, a parent or guardian must be in the water for the duration of the swimming lesson.

Children remain the sole responsibility of their Parent / Guardian until the child enters the swimming pool at the start of a swimming lesson.

Please do not distract or interrupt the teacher or pupils on the pool side, during a swimming lesson.

Non-swimming children who accompany parents / guardians to swimming lessons, must remain under your supervision at all times.  Children are not permitted in the hotel, gym facilities or unsupervised in outside parts of the premises where the lessons are taking place.

Photos or video recordings of children swimming in the water or in the changing areas is strictly prohibited

These terms and conditions are governed and construed in accordance with Irish Law.
